Who We Are

This website, cemlif.com, is operated by the practice of Dr. Mark Frenkel, 6101 Pine Ridge Road, Naples, Florida 34119. This policy explains what personal information we collect through this website, why we collect it, how it is handled, and the choices you have.

Information We Collect

We collect information directly from you when you fill out a form or use the image-upload tool on this site. The forms on this site are:

  • Contact Us — name, email address, phone number, and your message.
  • Free MRI Review Request — name, date of birth, address, phone number, email address, insurance company and member ID, and health-related information you choose to provide, such as whether a surgeon has recommended lumbar surgery and who that surgeon is, prior neck or back surgery history, and details of any recent MRI or CT scans. Depending on how you choose to share your imaging with us, we may also collect the name and phone number of your imaging facility, or the name of the hospital or imaging-center patient portal that holds your images (we never ask for passwords).
  • Upload Your Images — patient name, date of birth, email address, phone number, the name of any referring physician, and the medical image files (for example, DICOM files from an MRI, CT, or X-ray CD) you choose to upload.
  • Spine Surgeon Contact — name, email address, and any comments you submit.
  • Referring Physicians — a patient’s name, phone number, date of birth, and email address, along with the referring physician’s name, phone number, and email address.

Some of the information collected through the Free MRI Review Request, Upload Your Images, and Referring Physicians forms is health-related information — for example, the fact that you are seeking evaluation for a spinal condition, prior surgical history, imaging details, or the images themselves. We collect this information only because you have chosen to provide it in order to request a review or make a referral, and we use it only to evaluate your candidacy for care and to coordinate with you. We do not sell this information, and we do not use it for advertising or marketing purposes. Please do not send us portal passwords; if you choose the portal-access option, we will contact you to arrange access in a secure way.

Depending on the option you select, your imaging may reach us in one of four ways: (1) you upload it through the Upload Your Images tool on this site or, as a fallback, through the third-party image-sharing service mymedicalimages.com; (2) with your permission, our staff call your imaging facility and ask them to send us a copy; (3) you mail a CD to our office; or (4) you share access to your hospital or imaging center’s patient portal.

When you submit a form on this site, the information is stored in our website’s database and is also emailed to our office so that our staff can respond to you. Images uploaded through the Upload Your Images tool are not stored in the website’s database; they are transmitted directly to secure cloud storage we control, hosted by Amazon Web Services.

How We Use Your Information

  • To respond to your inquiry, review the information and images you send, and let you know whether you may be a candidate for care.
  • To contact you by phone, text message, or email about your request. By providing your phone number and checking the consent box on a form, you agree that we may contact you in these ways about your request. You may withdraw this consent at any time by contacting us.
  • To operate, secure, and improve this website.

Cookies and Similar Technologies

When you first visit this site, a banner asks for your permission before any optional cookies or third-party scripts are used. No analytics, advertising, or third-party content loads until you choose to allow it. Your choice is stored in a first-party cookie (cemlif_consent) for six months, and you can change it at any time using the “Cookie Preferences” link in the footer of every page. Our services fall into three categories:

  • Necessary — required for the site to work: remembering your cookie choice and, for our staff only, logging in to the site. These set no third-party cookies.
  • Statistics — Google Analytics, which helps us understand which pages are useful (pages viewed, general location, device type, and similar aggregate information). Google Analytics 4 does not log or store IP addresses.
  • Marketing and third-party content — Google Tag Manager, the Meta (Facebook) Pixel, embedded YouTube videos, and the reviews widget on our Success Stories page. Meta may use pixel data for its own advertising purposes, subject to Meta’s privacy policy. These services are never loaded on the pages where you request a review or submit health information (the Free MRI Review, its confirmation page, the Upload Your Images page, and the Conditions page), regardless of your cookie choice.

If your browser sends a Global Privacy Control or Do Not Track signal, marketing services are turned off by default. Full details of each cookie are in our Cookie Policy. You can also block cookies through your browser settings; doing so may affect how parts of this site function.

Embedded Content From Other Websites

Pages on this site include embedded content, such as YouTube videos and a reviews widget. Embedded content from other websites behaves as if you had visited the other website directly. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that content. On this site, embedded content only loads after you accept “Marketing and third-party content” cookies, and our video embeds use YouTube’s privacy-enhanced mode.

Service Providers and Who We Share Your Data With

We do not sell your personal information. We share information only as described here:

  • Our office staff, to respond to and follow up on your request.
  • Amazon Web Services, which hosts the secure storage used by our Upload Your Images tool.
  • mymedicalimages.com, an independent medical image-sharing service, if you choose to upload your imaging through it instead of our own tool. Its handling of your images is governed by its own privacy policy.
  • WordPress.com (Automattic), which hosts this website, and its Akismet service, which screens form submissions for spam. Akismet receives the content of form submissions in order to do so.
  • Google (Analytics and Tag Manager) and Meta (Pixel), only if you have accepted the corresponding cookie category, and never from the health-information pages described above.
  • Where required by law, or to protect the rights, property, or safety of our practice, our patients, or others.

Comments

Comments are closed on this site. If we enable them in the future, the data shown in the comments form, along with the visitor’s IP address and browser user agent string, would be collected to help with spam detection.

How Long We Retain Your Data

Form submissions are retained in our website’s database so that our staff can respond to and follow up on your request. We do not record the IP address of visitors who submit our forms. Images you upload are retained in our secure storage for as long as needed to complete your review and any resulting care, and are then handled in accordance with our medical-records retention obligations. If you would like us to delete information you’ve submitted through this website, please contact us using the information below.

Security

This site is served over HTTPS, and images you upload are transmitted directly to encrypted cloud storage. We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security. Please do not send passwords or other credentials through this website or by email.

Health Information and HIPAA

Information you provide through this website is collected so that we can evaluate a potential request for care. If you become a patient of the practice, health information we maintain about you is protected under the Health Insurance Portability and Accountability Act (HIPAA) and our Notice of Privacy Practices, which is available from our office on request.

Children

This website is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information through this site, please contact us so we can delete it.

Your Rights and Choices

You may ask us what personal data we hold about you, ask us to correct inaccurate data, ask us to delete data we hold about you, or withdraw your consent to be contacted, subject to any legal or record-keeping obligations we may have.
